  • Emotive Eye operates as a sole business entity, bringing in expert freelancers when needed.

3. Services & Engagement Terms

3.1 Service Agreements

All services are subject to a written agreement, proposal, or contract before work begins. This will outline scope, deliverables, timelines, and fees.

By engaging Emotive Eye, you agree to provide clear briefs, approvals, and any necessary resources in a timely manner to avoid delays.

3.2 Project Timelines & Delivery

  • Estimated delivery dates will be agreed upon before starting a project.
  • Any delays caused by the client (e.g., lack of information, late approvals) may impact timelines and could result in additional costs.
  • Revisions: We offer a set number of revisions per project, as agreed in the proposal. Additional changes may incur extra charges.

3.3 Content Ownership & Licensing

  • Ownership of final content is transferred to the client upon full payment.
  • Emotive Eye retains the right to use work samples for portfolio and promotional purposes unless otherwise agreed.
  • Raw files (e.g., unedited footage, RAW images) remain the property of Emotive Eye unless explicitly included in the agreement.

4. Payment Terms

4.1 Pricing & Invoicing

  • Rates vary depending on the project scope. Clients will receive a formal quote or rate card before engagement.
  • Full payment terms will be included in the agreement. Standard terms:
    • For projects under £1,000 → Full payment upfront.
    • For projects over £1,000 → 50% deposit before work begins, balance due on completion.
    • Retainer or fractional contracts → Monthly invoicing, payable in advance.

4.2 Payment Methods

  • Payment can be made via bank transfer, PayPal, or other agreed methods.
  • All invoices must be paid within 14 days unless otherwise specified.

4.3 Late Payments & Cancellations

  • Late payments may incur a 5% late fee per week until settled.
  • If a project is cancelled by the client, the deposit is non-refundable. If work has commenced, a proportional fee will be charged.

5. Client Responsibilities

📌 The client is responsible for:
✔ Providing all necessary materials, branding assets, and approvals.
✔ Ensuring permissions for any supplied content (e.g., logos, third-party assets).
✔ Adhering to agreed timelines for feedback and approvals.

If delays occur due to the client, Emotive Eye is not liable for missed deadlines or additional costs incurred.


6. Liability & Disclaimers

6.1 Service Limitations

  • Emotive Eye does not guarantee specific business outcomes (e.g., increased sales, engagement).
  • While we take all reasonable measures to ensure high-quality work, we are not liable for indirect losses resulting from content use.

6.2 Technical & Third-Party Issues

  • We are not responsible for third-party platform changes (e.g., social media algorithm updates affecting content reach).
  • If a technical failure occurs (e.g., camera failure, storage corruption) during a shoot, we will reschedule or offer alternative solutions where possible.

7. Confidentiality & Data Protection

  • Any confidential business information shared by the client will be kept strictly confidential.
  • We comply with UK GDPR regulations in handling client data (see our Privacy Policy).
  • Emotive Eye reserves the right to refuse work that involves misleading, offensive, or unethical content.

8. Use of Subcontractors

Freelancers & Partners:
Emotive Eye may bring in trusted freelancers or external experts for specific projects. Clients will be informed if additional professionals are involved.

Third-Party Software & Tools:
For certain services (e.g., website content, analytics tracking), we may use third-party tools. Emotive Eye is not responsible for their terms or service disruptions.


9. Force Majeure (Unforeseen Circumstances)

Neither party shall be liable for delays caused by circumstances beyond reasonable control (e.g., natural disasters, technical failures, pandemics). In such cases, we will work to reschedule or find a reasonable resolution.


10. Termination of Services

Either party may terminate an ongoing agreement with 30 days’ written notice. In the event of termination:
✔ Any completed work will be invoiced and payable in full.
✔ Any outstanding balances must be settled before content ownership is transferred.
✔ Retainer clients will forfeit any unused portion of prepaid fees unless otherwise agreed.


11. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by UK law.
Dispute Resolution: In the event of a dispute, both parties agree to attempt a resolution via negotiation or mediation before pursuing legal action.


12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website.
